Volume IIII - Issue No. 3 - Fall 2001 LIP SERVICE An Illinois Appellate Court has upheld the conviction of a Defendant found guilty of violating an Order of Protection even though the Defendant had never been served with a copy of the Order. The Court held that the Defendant knowingly violated the terms of the Order since he was told of the existence of the Order by a police officer and the victim. TAKE STOCK A bill has been passed by both houses of the Illinois legislature which will make unexercised stock options marital property. [750 ILCS 5/503 (b)(3)] Illinois case law has previously held that stock options in divorce cases have no value and are not even property subject to distribution. ADDITIONAL NOTARIES PUBLIC The Illinois Secretary of State may now appoint residents of a state bordering Illinois whose place of work or business is within a county in this state. The appointment is contingent upon the other state authorizing residents of Illinois to be appointed as notaries public in that state. The appointment for nonresidents is for a one-year term.
