GRANDPARENTS' RIGHTS SUFFER AGAIN

The Illinois Supreme Court has issued another blow to grandparent visitation rights. The court ruled that the Illinois statute which permits courts to conduct a hearing to determine if it is in the best interest of a child to visit grandparents is unconstitutional in a situation when a grandparent seeks visitation from his or her own child (the child's parent).

The court concluded that the law impinges upon the fundamental constitutional right of parents to make decisions regarding the upbringing of their children.

The decision still holds out the possibility that the court may rule differently under a different sets of facts or when a parent is deemed unfit.

LAWYERS SUE REALTORS

The Illinois Real Estate Attorneys Association has filed suit against a Chicago real estate brokerage firm claiming the firm engages in the unauthorized practice of law.

The real estate firm advises its agents to tell clients they do not need an attorney to represent them at closing. The firm engages in-house attorneys and a title company to prepare closing documents.

The suit alleges that this practice is a conflict of interest since in-house attorneys are more beholden to the real estate firm than to the clients. The suit also argues that homeowners and buyers lose protection when they fail to have independent legal counsel.
